Water Quality Committee meeting summary

Reasonable Potential: Jimmy Boswell discussed Reasonable Potential data for most metal types of discharges. The WQCD Webinar included the topic in its January agenda. Questions remain and discussion needs to be followed-up with the Division.

Chemical Evaluations: The April 15 webinar will include further discussion of new Chemical Evaluation reporting requirements. Two issues concern CMA members: chemicals and when a permit is in extension status, and when information is not available on some re-agents. Examples of prohibited chemicals were discussed.

Regulation 61: CMA filed for party status in the Water Quality Control Commission’s upcoming rulemaking altering the regulation.

The responsive pre-hearing statement is due before the next CMA Water Quality Committee meeting on April 20.

Dredge and Fill: CDPHE has organized a series stakeholder calls for further discussion on potential legislation. No legislator has been identified as primary sponsor.

July 22—issue permits before no other precedent—other states such as Ohio and Washington appear to be working this on issue. Perhaps Arizona, as well.
