Federal Issues
Chris Riechard updated the Committee about WOTUS and 401 certification. EPA drafting a replacement rule as well as encouraging groups to form Roundtables to collect ideas for the second stage rule. Chris described some of the details EPA has clarified regarding the roundtables.
401 Certification: California appeals court vacated the 2020 water certification rule and applied the ruling nationwide. Status of nationwide permits uncertain.
